Pre-Order Terms & Warranty
TERMS OF PRE-ORDER (TPO)
The following are the general terms and conditions that apply to the placing of a pre-order (the ‘Terms of Pre-Order’, TPO) of one (1)Togoboat (‘Pre-Order’).
Togoboat (‘We’, ‘Us’, ‘Our’) encourages you to read through these Terms before placing a Pre-Order with Us. By placing a Pre-Order, You agree to be bound by these Terms of Pre-Order.
Please note that these Terms of Pre-Order are only applicable to the placing of a Pre-Order. Should You in the future decide to place an Order for a Togoboat, these Terms of Pre-Order will not apply. An Order and following purchase of a Togoboat will be governed by separate terms and conditions.
As things change, these Terms of Pre-Order may change too, so please make sure to read through these Terms of Pre-order. We will always notify You of any such update to these Terms of Pre-Order.
1. Pre-order
1.1. A Pre-Order is a non-binding order that makes you a prioritized customer for purchasing a Togoboat upon the start of sale of the Togoboat in the United States. These Terms of Pre-Order are not a purchase agreement or a binding order nor a confirmation or guarantee from Us that You will have a right to purchase a Togoboat with priority of other customers.
2. Placing a pre-order
2.1. By placing a pre-order, you are accepting the terms of the POA.
2.2. You must have the legal capacity to place a Pre-Order. This usually means that You,

Have to be over 18 years of age and not subject to guardianship or similar, or
-
If You are not over 18 years of age, You have your legal guardians consent and pay with a debit or credit card (that We accept) and that You are authorized to use.
2.3. You must place the Pre-Order online through the Togoboat webstore on the website (togoboat.com) (the ‘Site’) or related Togoboat mobile sites and applications (jointly called the ‘Online Store’).
2.4. You must provide accurate details and correctly fill in the mandatory fields.
2.5. You must pay the Deposit (as described further below in Section 3) or pay in full.
2.6. By finalizing a Pre-Order, you are accepting the Terms of Pre-Order, You acknowledge and confirm that you have read and agree to these Pre-Order Terms and Conditions.
2.7. Once You have finished the Pre-Order process and We have received Your Deposit, We will send you a receipt of Your Pre-Order to the email address provided by You (‘Pre-Order Confirmation’). This will be accompanied by a unique Pre-Order reference number.
3. The deposit
3.1. We will collect a fully refundable deposit (the ‘Deposit’) of USD 100, or the full pre-order price as indicated on the product page, excluding state and local taxes. No interest can be collected by You on the Deposit.
3.2. The Deposit is payable by one of any of the payment methods available on the Site. Upon entering Your payment details, Your details will be conveyed securely to our Payment Service Provider (‘PSP’) in an encrypted form via a secure line and are processed there.
3.3. All credit- and debit cardholders are subject to validation- and authorization control by the card issuer. Should the issuer of the given credit- or debit card refuse to authorize the payment to Us, You will receive a message that the payment could not be fulfilled and Your Pre-Order will be canceled.
3.4. Should You decide to place an Order for and purchase a Togoboat, the Deposit can be used as a partial payment thereof.
4. Cancellation and refund
4.1. You can cancel Your Pre-Order at any time without specifying any reason for doing so. Should You wish to cancel Your Pre-Order, please contact Togoboat Customer service according to the details above.
4.2. We reserve the right to also cancel the Pre-Order made by You at any time. Should we choose to do so, We will contact You according to the details You have provided when placing the Pre-Order.
4.3. Should You or We cancel Your Pre-Order, We will refund Your Deposit using the same payment method that You used for Your payment, unless this is not possible, without undue delay and in any case no later than fourteen (14) days from when We receive Your cancellation notice or You receive Our cancellation notice. Once the Pre-Order has been canceled, the Pre-Order reference number will no longer be possible to use.
5. No warranty
5.1. A Pre-Order is not a binding order or binding agreement to purchase, it does not grant You a right to purchase a Togoboat.
5.2. All images displayed of the Togoboat on the Online Store are for illustrative purposes only and are not to be considered as specifications of the Togoboat. Contact us for specific details.
6. Personal data
We will be the data controller for the processing of Your personal data when You place a Pre-Order. Information regarding Our processing of Your personal data can be found in Our Privacy Policy which is available on the Site .
7. Applicable law and jurisdiction for consumers
7.1. All Contracts between You and Us shall be governed and construed in accordance with the laws of the United States unless otherwise clearly stated.
7.2. If mandatory statutory Consumer protection regulations in Your country of residence contain provisions that are more beneficial for You as a Consumer, such provisions shall apply.
7.3. You as a Consumer may bring any judicial proceedings relating to the Contract before the competent court in Your place of residence or the competent court of Our place of business.
7.4. If We wish to enforce any of Our rights against You as a Consumer, We will do so only in the courts of the jurisdiction in which You are a resident.
WARRANTY POLICY

Applies to: Inflatable products manufactured by Togoboat LLC
Your Togoboat product has been manufactured using the highest quality materials and workmanship. All Togoboat products have been inspected and found free of defects prior to leaving the factory. This Warranty applies to the Togoboat Inflatables only.
1. WARRANTY COVERAGE
Togoboat LLC (“Togoboat”) warrants to the original purchaser that its inflatable products are free from defects in materials and workmanship under normal use for a period of one (1) year from the date of purchase (“Warranty Period”).
During this period, Togoboat will, at its sole discretion:

Repair or replace any defective inflatable components with new or refurbished parts at no charge to the customer.

Cover the cost of parts and labor for any approved warranty repairs.
This warranty applies only to products purchased from authorized retailers or directly from Togoboat LLC.
2. EXCLUSIONS AND LIMITATIONS
This warranty does not cover:
A. Improper Use & Damage

Damage resulting from misuse, abuse, negligence, or accidents (e.g., improper inflation, overloading, dragging over rough surfaces).

Damage caused by commercial, rental, or competitive use of the product.
-
Structural failure due to prolonged exposure to extreme heat, UV rays, chemicals, or improper storage.
B. Unauthorized Modifications & Repairs

Any alterations or modifications not authorized by Togoboat LLC.

Repairs performed by unauthorized third parties.
C. Normal Wear & Tear
-
Fading, discoloration, scratches, or cosmetic damage that does not affect functionality.

Normal material degradation over time, including minor air leaks that occur from aging.
D. Improper Maintenance & Storage
-
Damage caused by improper inflation pressure or use of non-recommended air pumps.
-
Mold, mildew, or other damage resulting from failure to properly dry and store the product after use.
E. Non-Inflatable Components
-
Electronics, motors, batteries, or accessories covered by separate warranties.
F. Incidental or Consequential Damages
-
Togoboat LLC is not responsible for indirect damages such as loss of use, inconvenience, rental fees, or third-party costs.
3. NON-TRANSFERABILITY
This warranty is valid only for the original purchaser and is not transferable to any subsequent owners. Proof of purchase is required for all warranty claims.
4. HOW TO FILE A WARRANTY CLAIM
To initiate a warranty claim, the customer must:

Detailed description of the issue, including photos or videos if applicable.
Step 2: Warranty Evaluation

Togoboat’s warranty team will review the claim and determine whether it qualifies for warranty service.

If approved, Togoboat will provide a Return Merchandise Authorization (RMA) number and instructions for return.
Step 3: Return & Repair Process

Customer must return the defective component at their own expense (unless otherwise specified).

Togoboat will inspect the product and proceed with repair or replacement if the claim is valid.

If the issue is not covered under warranty, Togoboat will provide repair options at the customer’s expense.
5. LEGAL DISCLAIMER
This warranty gives you specific legal rights, and you may also have other rights that vary by jurisdiction. Togoboat LLC’s liability under this warranty is limited to the repair or replacement of the defective product.

1. WARRANTY COVERAGE
Togoboat LLC (“Togoboat”) warrants to the original purchaser (“Customer”) that the electronic components of Togoboat products, including but not limited to motors, control elements, batteries, chargers, and electric pumps, will be free from defects in material and workmanship under normal use for a period of one (1) year from the date of purchase (“Warranty Period”).
2. WARRANTY TERMS
During the Warranty Period, Togoboat will, at its sole discretion:

Repair or replace defective electronic components with new or refurbished parts at no charge to the Customer.

Cover the costs of parts and labor for any approved warranty repairs.
3. EXCLUSIONS AND LIMITATIONS
This warranty does not cover:

Damage caused by misuse, abuse, or neglect, including but not limited to:

Improper installation, storage, or maintenance.

Use in extreme conditions not recommended by Togoboat.
-
Unauthorized modifications, alterations, or repairs.

Impact damage, including collisions with rocks, debris, or other obstacles.

Exposure to corrosive substances or submersion beyond recommended depths.
-
Normal wear and tear, including cosmetic damage such as scratches, dents, and fading.
-
Non-electronic components, accessories, or add-ons not manufactured by Togoboat.
-
Incidental or consequential damages, including loss of use, loss of time, or commercial losses.
4. NON-TRANSFERABLE WARRANTY
This warranty is valid only for the original purchaser of the product and is not transferable to any subsequent owner or third party.
5. HOW TO FILE A WARRANTY CLAIM
To initiate a warranty claim, please follow these steps:

The Customer is responsible for shipping costs associated with sending the product to Togoboat for evaluation.

Once received, Togoboat will inspect the component and determine whether the issue is covered under warranty.

If approved, Togoboat will repair or replace the component and return it to the Customer at no additional charge.
